Brazilian Senator Flávio Bolsonaro, who lost Sunday's presidential election to incumbent Luiz Inácio Lula da Silva, has been ordered to surrender his passports and barred from leaving the country amid a federal investigation into suspected financial wrongdoing.
The restrictions were imposed by Supreme Federal Court Justice Alexandre de Moraes, according to Brazilian media reports published on Monday, October 26, a day after the closely contested presidential runoff.
Federal police instructed Bolsonaro to surrender his travel documents within 24 hours, including his ordinary and diplomatic Brazilian passports.
The judicial measures also prohibit him from contacting lawyer Willer Tomaz, who is under investigation in connection with suspected money-laundering activities.
Bolsonaro, the eldest son of former President Jair Bolsonaro, confirmed that police had approached him after he visited his father on Monday.
In a video posted on social media, the senator said he intended to comply with the order but denied having any plans to flee Brazil.
He described the restrictions as politically motivated and linked them to comments by his brother Eduardo Bolsonaro, who had suggested before the election that he should leave the country if defeated.
Those claims have not been independently established as the legal basis for the court's decision.
The restrictions come as investigators examine alleged financial links between Bolsonaro and Tomaz, including business arrangements associated with online betting companies.
Brazilian newspaper Folha de S.Paulo reported that the investigation also involves questions surrounding financing connected to a proposed film about Jair Bolsonaro.
The senator and his associates deny wrongdoing. No conviction has been established in the matters underlying the restrictions.
The development follows a historic presidential election in which Lula secured a fourth term, defeating Bolsonaro by more than 4.4 million votes.
Brazil's Superior Electoral Court recorded 51.79% of valid votes for Lula and 48.21% for Bolsonaro, confirming the incumbent's victory.
Bolsonaro initially refused to concede, questioning a judicial decision that extended voting hours at some polling stations because of transportation difficulties and severe weather.
However, electoral authorities said the additional voting period did not alter the outcome.
His Liberal Party subsequently acknowledged Lula's victory, while Bolsonaro indicated that he would continue opposing the government and could pursue legal challenges concerning alleged campaign abuses.
Those allegations are separate from the financial investigation underlying the passport restrictions.
The decision to restrict the defeated candidate's travel has intensified political debate in Brazil, where the judiciary and the Bolsonaro family have been involved in several high-profile confrontations.
Jair Bolsonaro is serving a sentence following his conviction over an attempted coup connected to the 2022 election.
For Flávio Bolsonaro, the immediate legal consequences are restrictions on international travel and contact with a fellow investigated individual, rather than a criminal conviction.
The case also carries broader political significance as Brazil prepares for Lula's next presidential term amid deep divisions between the country's governing coalition and conservative opposition.
Further developments will depend on the progress of the investigation, any appeal against the restrictions and whether prosecutors ultimately bring formal charges.
